Subclass 103 & 804

Parent Visa

The parent visa permits a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen move to Australia.

Overview

  • This is an offshore visa for parents of any age. The parent may be in Australia or overseas at time of application, but must be overseas at time of grant.

Apply as a retiree

 The applicant can apply for a Parent visa (subclass 103) as a retiree if:

  • on 8 May 2018, the applicant held or had previously held an Investor Retirement (subclass 405) visa or Retirement (subclass 410), and have not held any other substantive visa between between 8 May 2018 and the date you applied for the Parent visa

If the applicant apply for this visa as a retiree:

  • you don't need to meet the balance of family test
  • you don't need to have an assurance of support
  • you don't need a sponsor
  • you don't need a sponsor. 

Sponsor

  • An eligible child over 18 must sponsor their parents otherwise  an eligible relative or community organisation can be a sponsor for their visa. 

The balance-of-family test

  •  The applicant must meet the balance-of-family test.   

Assurance of Support

  • The applicant need to have an Assurance of Support, unless he or she are applying for the Retirement Pathway. 

The health and character requirements

All the applicants (including family members) must meet the health and character requirements. 

Debt to the Australian Government

  • The applicants (including family members) must not have any debt to the Australian Government. 

Visa cancelled or a previous application refused

  • While the applicant  were in Australia and If their visa cancelled or visa application have been refused then they  might not be eligible for this visa. 

Health insurance

  •  While  in Australia the applicant are personally liable for all their healthcare costs. 

Australian values statement

  • The applicant who are 18 years of age or older must have read, or had explained to them, the Life in Australia and sign an Australian Values Statement.  

Best interests of the child

  • The applicant might not grant this visa if it is not in the best interests of an applicant under 18.

Parent 103 visa assessment

Overview

  • This is an onshore visa available only to ‘aged’ parents. The parent must be in Australia at time of application and at time of grant.
  • Applicants for the 804 visa may be granted a bridging visa to enable him/her to remain in Australia for the duration of the processing of the application.
  • Applicants for the 804 visa must not have a visa subject to the 8503 No Further Stay condition, or be restricted by s.48 of the Migration Act.

Age

  • The applicant must be  be old enough to receive the age pension in Australia.   

Sponsor

  • An eligible child over 18 must sponsor their parents otherwise  an eligible relative or community organisation can be a sponsor for their visa. 

The balance-of-family test

  •  The applicant must meet the balance-of-family test.   

Assurance of Support

  • The applicant need to have an Assurance of Support, unless he or she are applying for the Retirement Pathway. 

The health and character requirements

All the applicants (including family members) must meet the health and character requirements. 

Debt to the Australian Government

  • The applicants (including family members) must not have any debt to the Australian Government.
